What does this insurance cover?

The policy is only available in one type of contract with the following coverage:
- Civil liability of insured persons:
- Losses and legal expenses for claims filed against the administrators, executives and people exercising certain management or supervisory functions in the SME and its subsidiaries, as well as those referring to individuals who exercise a senior position in investee companies when they have been expressly appointed to the post by the SME.
- The coverage also covers claims filed against married or civil spouses, heirs, legates, legal representatives and their successors, as well as claims filed against employees who carry out management or supervision tasks, or when they are sued together with the administrators and directors.
- Reimbursement to the company: reimbursement to the SME, when it can or is required to pay insured persons for losses and legal expenses arising from claims.
- Bonds:
- The constitution of civil bonds.
- The expenses of establishing and maintaining a bank guarantee.
- Fees to establish criminal bonds.
As required by judges and courts from insured persons as a result of claims.
- New subsidiaries: coverage extends to the insured persons of subsidiary entities incorporated or acquired by the SME during the insurance period.
- Heirs, legatees, legal representatives and successors: extension of coverage for claims resulting from a wrongful act committed by the deceased Insured who has been declared incompetent, insolvent, bankrupt or a debtor.
- Spouses and Domestic Partners: andextension of coverage for claims arising from a wrongful act committed by the Insured and that seek to remedy damages through the use of the joint or common property of the spouses or couple.
- Positions in Investees: defense expenses and losses arising from claims against people who hold a position as an Administrator, Director, Executive, Manager, Trustee, Member of the Board of Directors, or an equivalent position at an Investee and who have been appointed by the Company.
- Extended coverage for 24 months: information period immediately after the last insurance period, during which the insured persons they can file claims for acts committed prior to the maturity of the policy.
- Defense against pollution claims: expenses incurred in the defense of insured parties in claims involving accidental pollution.
- Subsidiary tax civil liability: losses and legal expenses to be paid by the insured individuals as bearing subsidiary responsibility for the tax debt of the SME.
- Civil liability of the founder: covers claims against an insured party or a employees, who were involved in founding the SME or of an entity subsidiary.
- Bankruptcy guarantee: costs of establishing and maintaining the guarantee that could be accepted in lieu of an ordered embargo against the insured person during bankruptcy proceedings of the SME.
- Restoration of public image: expenses incurred by the insured persons in advertising or in the design and execution of an advertising campaign, aimed at restoring the status of their public image.
- Formal investigations: legal expenses for the insured individuals for appearing at an internal or external investigation SME as a result of a claim.
- Breach of employment practices by an Insured: covers claims arising from the violation of employment practices filed against insured persons, employees, or the SME itself.
- Administrative fines and sanctions: imposed on insured parties, as a result of any process, official investigation or formal inspection, carried out by a public body with inspection or oversight authority.
- Retired directors (6 years): effective information period from the date of maturity or cancellation of the policy, to cover claims for acts committed prior to that date, when a senior manager stops holding office.
- Claim against the Policyholder for violation of Employment Practices: obligation to pay any defense expenses or loss that arises from a claim caused by or based on a breach of employment practices on behalf of the Policyholder. The Company is included in the definition of the Insured under this insurance cover only.
- Legal expenses for reckless homicide or for involuntary violation of the Occupational Risk Prevention Law: legal expenses for the insured individuals for claims alleging negligent homicide or an involuntary violation of the Occupational Risk Prevention Law or similar legislation in any jurisdiction in relation to the business activity of the SME.
